The Over-50 Presumption is Here to Stay, For Now

This presumption was in the news a lot in the fall of 2025. After initially announcing plans to follow up on his first term’s agenda and end this presumption, U.S. President Donald Trump quickly reversed course. As outlined below, this presumption essentially states that disabled workers over 50 have low RFC (residual functional capacity) scores and therefore have an easier time obtaining Social Security Disability benefits.
However, these applicants aren’t automatically entitled to benefits, partially because an informal reverse presumption also applies in these cases. Many state DDS (Disability Determination Services) officers feel that if disabled workers have lived for years or decades without benefits, they can continue to do so. General Rules
Essentially, individuals who have sufficient work credits and have qualifying disabilities are eligible for monthly cash, Medicaid membership, and other SSDI benefits.

- Education: A “disability” is not exclusively a medical term. Especially if they’re over 50 (old dogs can’t learn new tricks), individuals with little education, such as miners or other traditional blue-collar workers, have a harder time adapting to other kinds of work, increasing their chances of being approved for SSDI benefits.
For individuals over 50, the SSA assumes that it is harder for them to learn new job skills or retrain for a different type of work, especially if their disability limits their physical or mental abilities. Therefore, people over 50 may find it easier to qualify for SSDI if they have a disability that significantly restricts their ability to do any kind of work.
